Violence!
What we have here is a disparity between the law and the need to defend one's self and / or family.
It's not often you have disparities like this because the law tries to keep up with people's rights ... well, at least that's the socio/legal theory anyway.
When we try to rationalise hypothetical events such as burglars in your house who subsequently threaten your family, we are gonna lose sight of any real notion of 'justice' and commonsense and set about dealing with the situation that one might confront under those circumstances.
Statistically, it's extremely rare when intruders do come face to face with the residents and so we are really dealing with an extremely rare occurrence indeed.
However, the law is constructed by supposedly intelligent, rationale individuals and it is imposed upon situations like these where the thought processes of those involved is gonna be anything but calm and rational.
And when people 'talk' of doing this, that or whatever if and when confronting an intruder, it might well serve you better to consider the following, the people who execute these type crimes are generally predisposed to violent behaviours and are probably [for want of a better phrase] 'better at it' and will be generally tooled up for the job in hand.
And in this case, tooled up isn't meant to describe the equipment to break in anywhere ... it's meant to describe the weapons they might carry to deal with the possibility of coming face to face with the resident.
There are few burglaries carried out where the individual goes in with no tool to hand, whether it be a blade, club or whatever and you must remember this when deciding whether or not to go for them.
I have come into contact with a few of these type 'people' and generally speaking, they are desperate individuals trying to feed a drug habit that totally dictates the way they live their life ..... the only currencies they understand are drugs and violence .... this is the only thing they respond to in general terms.
As for what this means for the poor sod who is unfortunate enough to have one of these scumbags break into their homes?
If you are used to violent situations and willing to dispense it, then the intruder has a problem for sure and I'm all for injuring the intruder as much as you can without killing him; if the scumbag was brandishing a weapon, cool, then the defence you dished out is warranted; if there was no weapon on show, then I'm sure there would be one by the time the police turned up whether the intruder had one on him or not; and of course, the blade would have his dabs all over it.
If you are not acquainted with violent situations then the choice is a difficult one; sometimes the emotions [fear] will take over the situation and you will just go for the scumbag and then the fate of the outcome is in the lap of the gods; I know it's difficult but it's always best to try very hard to clear your head and think straight, almost impossible I know because the adrenaline will be pumping like a jack-hammer.
I would never advise an average Joe to resort to violence because to a certain extent it's playing right into the hands of the intruder, cos remember here, he's used to it, violence is one of the few currencies he understands and will therefore be prone to utilising it.
As a rule of thumb, if you are gonna do something, then get your hands on something; the best sort of defence here is a something that won't get you too near the scumbag [because of the likelihood of him stabbing you] but at the same time, do a bit of damage.
A pick-axe handle is perfect, if you use a blade, then you might have some explaining to do when it comes on top afterwords.
A pick-axe handle is something you might well have around the house and when wielded, causes a handsome amount of damage when it connects.
In fact, the mere sight of one in your hand is sometimes sufficient to persuade the intruder that it might be an opportune time to begin looking for an exit.
All in all, these are rare instances and people shouldn't get too bent outa shape considering what you would or wouldn't do, be thankful the incidence of these face to face encounters is as rare as it is.
The law is supposed to be unequivocal and precise but we all know it is sometimes completely out of step with the real world.
In instances such as these, we must remember the difference between conviction and punishment, it may well be a precise judgment in convicting you if you have dispensed what might be described as an 'unreasonable amount of force' when defending you or your family but when the judge comes to sentencing, we have already seen a glimmer of common sense from the sentencing judge.
The recent case whereby that Indian guy smashed the brains out of that ingrate who threatened and tied up him and his family had his sentence reduced to non-custodial and was freed from jail, and rightly so.
We live in a violent world, and it's getting world, we have nurtured feral children who have no moral touchstone in their lives and their influences range from violent dvd's to internet dross ... lord only knows what we got waiting for us round the corner and I can see no practical answers ...All I know is, violence breeds violence and when a large section of society grows up in this environment, the future does not bode well for law abiding citizens.
