As far as I understand it, and I am happy to be proven wrong, there is no legal right that farmers have to defend themselves with any form of air gun etc. This might be something they use to try and scare them off but should they shoot and injury a trespasser for example by shooting them in the eye. The farmer could land in some pretty hot water. Terms like "reasonable force" would come up and shooting someone in the eye for trespassing would probably not fall into that category.

I believe the rules are like this to stop vigilantes laying down the law. As it is a fine line from, I was protecting my family so had to shoot the burglar and it is his/her own fault if they are injured or die. To the next step of needing to keep a marker, knive, gun, etc on you to protect yourself/family when your out.

Even though air rifles, markers etc are not weapons designed to kill humans they can still inflict very serious amounts of damage. A friend at school was shot in the stomach by an air rifle at close range (do not know if it was FAC grade or not) and he was in hospital for quite a while. I was involved in an unfortunate incident where I was shot in the eye in a safe zone at a tourny a couple of years back with a paintball and almost lost that eye.

I understand your opinion but if this happened then the yobs outside would just have markers, airguns etc too and start wearing masks anyway. Then you are in a worse position as they can cause even more damage.

I am glad it is this way as opposed to the very "liberal" use of guns in the US. Which has caused high gun crime rates, etc.

If you want to protect yourself make your home as secure as you can and if things get out of hand call the police. Let them do their jobs. For when you go out maybe take a self defense course and learn about some of the techniques to minimise trouble in the first place and how to deal with things should they get out of control.

wasnt laws changed in the last few years to allow us to defend ou4 homes?

i believe and am not 100% sure on this as it might just have been a discussion

you can defend yur home as long as you dont chase them beyond escape of the property, dont bloke there exit, and dont over do it.

i remeber watching one of those morning shows where they was saying what you do in a panic sate cant be held over you. i believe if you was to knock them out or they give up you must stop the attack. and i believe there was also an example of sum1 killing and intruder and using the fact the was under a paniced trance to get away wth it.

to be honest mate the police were called and in typical police fashion they turned up 5 minutes to late, the gang had literally just walked round the corner when they turned up so if they sent a car round the corner they would have had em all i think that is pathetic for the police force as i live next door to the station thats why i think we should be able to either 1 use other sports equipment or 2 shoot em in the face repeatedly till they stop kicking your door in.
fortunately my nan and grandad hadnt got in from the pub but they would have been beside them selfs all night if they had witnessed the attack on their grandson and their house.

i have been stopped by the police plenty of times for looking suspicious or pulling me over in my car after i had just passed my test a couple of years back when i hadnt actually done anything wrong but as soon as something happens and i need em, there never here on time !

I think if a burglar or worse breaks into your house it is natural human instinct to defend yourself and your family from a possible threat to your lives,so i dont think you would have the time or even think about going to your kitbag to get your marker then gas it up put a hopper on it & fill the hopper with paintballs then go hard charging around your house trying to expel the said threat,your more actually to pick up the first thing that comes to hand whatever that may be.
But lets just say you did have time to get your marker gassed and ready to fire while the threat to you and your family's wealth-fare is down stairs ransacking your house,i honestly dont think you would give a rats ass about harming the reputation of the paintball scene if you shot them with your paintball gun i think your thoughts would be elsewhere.

I only know if someone were to break into my house with the possibility of harming myself and my family i would defend my loved ones with whatever means at my disposal regardless of the the law say's,if i have to do 12 months for GBH etc................so be it !!!

There was a case in the news just this week detailing what you can and cannot do regarding home invasions etc.

However, there are additional factors. The homeowner should be acting instinctively, fear for their own safety or the safety of others, or act in order to make a lawful arrest (or prevent someone who is lawfully detained from escaping).

The law does not protect those who set upon a fleeing criminal or who lie in wait to attack them. This would amount to people taking the law into their own hands.

The Lord Chief Justice made it clear that the Hussain case was 'exceptional', and that the 'call for mercy' had to be answered."

I have to agree with outkastmike that if anyone broke into my house & threatend myself & my family i would do anything to defend them & suffer the outcome later, i think 90% of people would do the same as for useing your marker i would probably use it but not shoot them in the face? as for banning paintball because u used your marker i wouldnt like to say. but they dont ban baseball if someone uses a baseball bat ,& i know your marker is classed as a firearm.

i was told that if you fear for your safety or feel threatened by an attacker/agressor then you can attack them first (pre-emptive strike)

aslong as you use the minimum force required to ward off the attacker and say exactly as the above in any police statement then it can be favourable in your direction.

folks correct me if im wrong.
