thats true i think you hit the nail on the head there.

Any way to ferther this i phoned the regional manger and asked if he could expand on why i didnt get the job and this is what he said . The company belives that smoking more then "4" cigs a day is bad for you healf and effects there insurnace policy .... What 4 a day is bad for you bloody hell one a day is bad for you !!!!!

apprently and this is rumour BTW they didnet empoly a lady because she was over wight becuase they would have had to Pay more money for a larger uniform. This may be true due to me being told by one of the magers in another part of the company .. so it loks like ICM are complete gits any how.

So if any one in the north east here needs a realy good hardware and software tecnical engineer plz let me know cos my contract finishes this month.

P.S i have dislexia notice that didnt bother them ....

There was a study done where the results showed people that smoke took enough time out for cigarette breaks that it was the equivalent to people who didn't smoke having an extra 4 days holiday a year IIRC.

When a company is looking to employ you I think there is no legal reason why they can say no if you smoke. It's just a company preference thing, unlike race sex etc. It's perfectly legal to refuse you because they don't want heavy smokers.

I don't believe it's descrimination. You have a choice whether to smoke or not. You choose to smoke. They choose not to employ you. The cost of employing people that smoke is higher. That's why they choose not to take those extra costs.

I think descrimination is about things you can't choose or control, like race, sex or handicaps.

Simple answer. You want the job there, meet their criteria.

Jesus mate, that's horrible, i wouldn't discriminate against you because you smoke and I'd like to offer you a ........

Oh, no sorry you're from the North East.

:D

I think the problem is that smokers are entitled to extra breaks and special considerations........ it leads to a lot of strife in the workplace........ my place of work just had to change all of the rules as the non-smokers were getting sick of it. It's caused a lot of problems. And in a world where most vacancies are over-subscribed you can afford to be picky. If you push it, they'll just say "oh no..... we just found someone better qualified" the manager did you a favour...... he was honest, most wouldn't have done you the courtesy.
As for discrimination..... I can work between my breaks at full efficiency as I don't have a biological need for specific chemicals..... can a regular smoker? it's accepted that a smoker does need these breaks........so a non-smoker will perform better (at least for those 5 minute periods when the smoker isn't there).
You've got two identical applicants, only one of them smokes...... who do you employ?
It all gets taken too far......... I can't teach french, that's descrimination (on the grounds I don't speak french), I can't be a pro-basketballer (as I'm only 6 feet tall), I can't play one of the seven dwarves (see previous) and I can't get a job at Man United (cos I'm crap at football). Honestly, where is the line between making a choice/discriminating?
