I answered yes and put 20 a day wich for me is a advrige. when i finished i handed the papers back to the area boss and he whent off to take them back to the company office.

I came home and told every one I HAD A FULL TIME JOB !!!! :) ....

Any way i was realy happyuntill monday. I came into work and abou 09:30 i got a call on my mobile and it was the area boss .. This is what he said to me " Michael i am sorry to tell you this. I cannot employ you as the head office has turned you down becuase you smoke to much ?."....

I cannot type down what my replay was to that but i did ask him if he was jkeing and this was some sort of covery up. He told me it was the honist truth...

Thats bloody harsh!!

the way I look at it is this... they were perfectly happy with your performance in the job UNTIL they found out you smoked, then turned you down... that is a complete violation of equal opportunities and they may as well have turned round to you and said "No job because you're Gay" (If you were)

Unfortunatly mate this is the way industry is going, they make more money from people who don't smoke because they have less fag breaks and so... dont need to stop work.

Also, its a kind of new health insurance policy in some industries.

They base it around how much money they can make from you and if they found out you smoke they refuse the offer.

Sorry mate but its not like you are forced to smoke lol :D :D

That is definitely not right, not to say illegal. Actually he's not even aloud to ask you because that part of your private life. Like not asking you what your political affiliations are, what your sexuality is etc... You can't turn someone down on the pretext that he smokes. In Switzerland that is definitely a violation and you could take the guy to court. Obviously you would have to find someone ready to be a witness that that was the official reasonand it wouldn't be easy but it is against the law.

Saying that you drink loads thats another question. Drinking can definitely hinder your performances but not smoking.

You cannot lie on your application form (so you can't say "no") but you do not have to disclose details of a personal nature.

If the question about smoking was a health-related issue, then it should have been made clear what the information is used for - it should certainly not be the reason why you do not get offered the job. Notice how you boss RANG you to tell you why?
There's no way they'd turn you down in writing based on the smoking issue alone because they'd be opening themselves up to all kinds of legal action.

Anyways... you're better off as a contractor... :D:D:D
