Possibly the best recourse is for the person who has been left out of pocket to take the individual to the small claims court and present the facts. Judge will then make a decision and a court order will be produced for any debts to be settled.

If somebody provides me with his fone number I'll give him a call but before I do so, I need to make sure the circumstances point toward him commiting fraud of some kind, and so Jim, can you please gimme a bell whenever it's convenient and you can fill all the details in for me; the last thing I wanna do is talk to his parents and I'm not in full possession of the facts.
Thanks guys

Give you a call this morning at some point Pete.

I have sent this email below to the policewoman who is dealing with this case.
i'm rattling the cage and we'll see what falls out but one way or another, we will be getting either the cash or prodduct back .. we have never failed in this respect whenever one of our members has been ripped off.... anyway, here is the amli I sent and so let's see what happens now :-

Hi Leanne,

I told you that I was more than happy to let things drop with regard to what I felt, and my solicitor felt was a wholly inappropriate dictate from yourself.
That aside, I’m still left with a guy who has defrauded a member of my website and so, we can go one of two ways here, we can lodge a formal accusation of fraud against this jamie fellah, or we will accept all the product / gear he has defrauded from our members ... you were personally quick off the mark to help this guy when he bought along his mother, and as i said to you, you hadn’t in any way bothered to find out the other side before sending me that inappropriate email which does tend to irk me somewhat for obvious reasons.
I would like you to get in touch with the mother/ father and ask them to call me please – my number is 07515 890385, and the reason I ask this is because if nobody gets back in touch with me re this problem then individuals will be forced to go round to try and reclaim the goods he has defrauded from my members.
Now I’m damned sure this kid has told his mummy a real load of crap and conveniently forgot to let her know what he’s been up to, after all, she doesn’t wish to believe her son would ever do anything illegal as fraud ... but he has ....
I am the owner of the website as you know, the paintball community is an extremely tight one and if some guy defrauds another paintballer then things go from bad to worse if it’s not resolved.
All the members of my site thankfully respect and trust me, and if I tell them to just leave it to me to sort out then they are not gonna make any moves to retrieve the gear which is not the way to go for obvious reasons.
But the only way I can assure people is by telling them we have been in touch with his parents and they are arranging for the gear to be sent back, anything less is gonna be a problem. If I cannot tell them this, then I wash my hands of all of it and things fall outside of my control which is not the situation either you or I would want.
If you need to, you can call me anytime on my mobile – let’s hope we can resolve this situation quickly for everyone’s benefit.

Regards

Peter Robinson

I have just had a heated exchange with a copper who just called me up re this jamie prick; it didn’t go well I’m afraid for several reasons – firstly, he tried to justify the email that his colleague [mrs Plod] sent to me and he did it by suggesting that from what they knew at the time, it was appropriate they get in touch with me. I
straight away countered, ‘but you didn’t get in touch with me at all, you sent me an email demanding I take stuff down from a public forum website that I owned … this is outrageous and you know it’

I added, ‘if you guys had contacted me and asked what was going on’ then I would have had no problems but you didn’t, you took the side of some lying kid and his mother and didn’t bother to ask any questions before sending that email to me.
I also added that I had been in touch with my solicitor and he had advised me that normal police protocols were breached here and what had happened was wholly inappropriate; the copper at the end of the phone began metaphorically wiggling to try and maneuverer into a position less damning, he was unable to do so …… I didn’t let him.
The copper then went on to tell me that he didn’t think there was a case to answer because the kid’s dad had assured him that no crime has been done and his son had not received any gear …. I was dumbstruck .. again …. This copper had listened to this kid’s dad and decided we were at fault …. All on the basis on this kid’s father’s statement to him ….not once has he, or any of his colleagues made any representation to us to try and find out what’s going on … not exactly a balanced approach to investigating a case of fraud is it …
I informed the copper that I don’t give a **** what his dad says, we will get the money back as we have done in many similar cases like this we have had over the years … and we will.
The copper also advised me not to go to any debt collecting agency to recover the money or the gear … now, what right has he to tell me what to do, in a case that hasn’t been fully researched????
This is another inappropriate action by the police …. I might as well have been sitting with my thumb up my ass talking to an anvil ….
It’s insane, it really is insane …. I bet the villains in this country sit at home at night and laugh till their bollox drop off ….
I knew this conversation was gonna go one way, and that was with me shouting at him and putting the phone down .. I didn’t disappoint myself … though I will add, he did ring straight back and before he got a chance to speak, I asked him, ‘what do you think happens when someone receives a call from somebody they don’t wish to talk to’?

It don’t take no rocket science degree to work out what I did next …
At this point, we need to do a couple of things, we need to collate all emails or messages that relate to this kid’s fraud, once that is done, send it to me, and I’ll make sure the correct procedures are adhered to from then on.
Let’s make sure we get the money/gear back …

Would this be the father Jamie claimed didn't live with him?? How does he explain the photos of him and his gear on Facebook and his profile pic here?

I would say the absolute unedited thread here should provide more than enough evidence of Jamie's lies and backtracking. It will take someone a while to sift through and unravel but it's all there. Lies on top of lies.

I just received an email from the copper that called me up, it makes interesting reading - I have responded to his email below. Have fun in reading it all ... it's outrageous :/

Mr Robinson,
I advise you to contact your local police to report any allegations of fraud that you wish to make. No debt collection agency will be enpowered to recover any property without a court order providing them with such. At this stage, without you making an allegation of fraud to the police, it remains a civil issue of recovery of debt which is not a police matter - however the family have been advised to ring 999 if people attend the address attempting to recover any property without proper authority to do so, and any people attending the address without property authority may be committing offences.
A/PS 20703 Bathgate

This is the second email I’ve received from you guys that irks me ... as to why it irks me?
Well, first off, I’m not responsible if anyone going round to his address; I haven’t lost any money or paintball gear and the only interest I have in this is to ensure the financial safety of my members .. that is my sole concern.

We have had a myriad of kids who do this over the years, I’m sick of it, and I’m even more sick of these parents who don’t wish to believe their little kids could ever do such a thing .. but they do ... just like this kid has.
I find it difficult to accept your position here, you seem to have listened to one side of the story with absolutely no attempt to contact us and ask us what’s been going on .. instead I receive a heavy-handed email from your colleague that was entirely inappropriate and now you try to tell me not to do this, and not to do that ... have you told the kid not to commit fraud again??
No you haven’t have you ... what do you think that says about the way you have gone about things here ??

I have no intention to step outside the law here, if individuals do happen to go around to recover the money/goods, guess what, I won’t be one of them ... and you are right to tell the kid’s dad to call 999, we certainly wouldn’t want that now would we .. officer.

I have advised the people concerned to collate all emails and communications with this kid and present them to the fraud squad, and i believe they have already been in touch with the relevant police department and they do have case numbers .. and so the wheels are rolling .. thankfully.

All of us, have the same wish here, we just want what’s owed us and we wanna make sure this kid doesn’t scam anyone else .... that’s all.
I will not be breaking any laws and I won’t be instrumental either in any laws being broken but individuals are at liberty to try and get the money back as long as it’s not illegal ... and that is exactly what will be done here.

I should go out and steal a car (I already know the police aren't really going to investigate the theft anyway, just provide a crime number for my insurance), and if anyone else finds out what I did, and tries to do something about it - I can report those guys to the cops for hurting my feelings, and the cops will back me up.
Sounds awesome.

Pete, as usual, I admire your unwavering dedication to this forum and its members. Just be sure you don't get yourself into any kind of hot water. This little boy isn't worth the **** off your shoe and it sounds like you won't get any better results from his parents. No surpise there. ****ed-up parents make ****ed-up kids.

PS I just sent this addendum to the email I just sent :-

We have reason to believe that the father, who the son said had actually signed for the gear that was delivered, is in some way complicit in what’s going on here .... it should come as no surprise to you that not everyone tells the truth .... especially when confronted with a police officer.
And have a think about motive here ... what the heck do we get out of all this, why on earth would we arbitrarily pick on some kid and accuse him of fraud .. it makes no sense .. and yet, the kid and his father have an outrageous motive for coming up with their story ... it doesn’t take too much to work out what’s going on here .....
