There is NO proof that the parcel was ever delivered, as you said yourself. RM are not Knights In Shining Armour. I trust them as far as I could throw them, with a full bag of parcels, into the wind. they have messed up many-a-sale for me, and im sure other users will have similar experiences.
This wont go to court, so get that out of your head, there's no solid basis for opening any sort of trial. Evidence = Case. unless your applying for Judge Judy or something.
This guy offered to repair your (yes, YOUR, you bought it) Marker. that is a sign of good nature, in my opinion. he could have quite easily left you to it, or YOU could have quite easily said 'can you send a replacement 'noid instead?'
I know its been covered, but the 'ah, he sold it to a minor' needs to stop, if you had a problem with that, you wouldnt have clicked 'send' on paypal... really.
