I can see this going to court and i can see the member nuts winning, this will be very costly for this member stu, who so far i have found has not had much to say.

putting your head in the sand is not going to help court costs are very heavy.

The deliv has been recorded the post office have said that it has arrived so it is up to stu to sort that out with them. and refund or send the repaired marker

Seems to me as though you (Nutz) are holding Grieve responsible (by default) for The Royal Mail's inability to deliver a parcel, and for it's under-insurance.

Aspects such as legalities of selling to minors etc is academic and pointless, as are the threats to sue, these are just hot air I'm afraid because you know full well you ain't gonna bother going down that road..As far as Grieve is concerned, he took the money and sent the marker, it subsequently turned up in less than good order to which Grieve responded by saying he would repair it....the important thing to note here is, everything Grieve has done and said up until this point, is above reproach.

This all starts to go titz up when the RM fail to deliver and you do not adequately insure the transit item, and both of these issues are not, and were not, the responsibility of Grieve.
In both those considerations, Grieve had no culpability whatsoever.

Now unless I have gotten things wrong (which is always possible) the primary problem isn't Grieve at all, it is RM and then this was made worse by the secondary problem, that of under-insurance.
ok two simple points he has the marker, i have proof from royal mail, and two buyers beware, hate for any other ballers to suffer this off grieve, i take the points about the minor on the chin, as for the legal apects of posted deemed delivered, i have been to the small claims track on this issue before and won, so tested that resolve has been, this is an attempt to get what is rightfully my property, and maybe through peer pressure, from the masses may make him see sence, even though the supporters of grieve must think why do (i) push this envelope,
rightly so i paid for the goods, which were defective, sent them back at (my expence) then get ripped off. i could play the lottery and provide the last four digits of his phone, which would however answer one question, he responded to my first letter, which he also never signed for, so work the math here ?????

Getting the impression that replacing the solenoid yourself might have been cheaper/less hassle than posting on here ;)
hind sight is a wonderfull gift, which in this instance what not working too good, but trying to save my nephew £80.00 cost him £240.00:cool:

You say about him seeling to a minor, then you say its your property :rolleyes:

P.s. I am on no-ones side but i do know Stu and he is not the type to do this on purpose

Sorry nuts but the fact that he didn't sign for the letter yet recieved it does not mean that he did in fact recieve the marker which wasn't signed for. That sort of logic doesn't make sense to me, although I can imagine it would work perfectly in a court of law for that very reason.

The question is, why would Grieve bother to deny all this if he actually had the marker, he certainly won't be able to use it ever again in a public place as every bugger on here would know what it looked like if you posted up a description. Grieve also plays for the Freekz who run a popular training site down south which would also stop him training with the marker as the amount of people at the site who would see said marker would again cause him problems.

It seems like we have two innocent parties who are bashing heads for no reason and as many people have already stated Royal Mail have made a boo boo. Unfortunatly your under insurance won't help you with getting anything from them.
