SMART PARTS COMPLIED WITH THE INJUNCTION BY MAKING THE NECESSARY CHANGES TO NERVE, SHOCKER AND IMPULSE MARKERS.

SMART PARTS IS CONTINUING TO SHIP ITS NERVE, SHOCKER AND IMPULSE MARKERS. NO MARKERS SOLD SINCE DECEMBER 10TH INFRINGE.

DEALERS NEED NOT WORRYABOUT PAST OR FUTURE SALES OF ANY SMART PARTS MARKERS.

THE DAMAGES COVER ALL INDIVIDUALS AND DEALERS WHO PURCHASED NERVES, SHOCKERS AND IMPULSES PRIOR TO DECEMBER 10, 2004.
So... what happens now? What changes did they make? Who's to say it no longer infringes?

would it be right for WDP to tighten the screws against SMART PARTS i think not
would WDP done the same thing if thay had all the so called patents???
no one forsure knows what is going on only the top peaple at WDP and SMART PARTS do
i think we are all jumping the gun at the moment let,s just wait and see
i for one can not get on with a angel but thats me
i perfur my SHOCKER and E2
at the end of the day WDP are not going to want to get a bad name like SMART PARTS did a while ago
both partys will come to a deal that suits them both

Hmm,

The injunction was on the markers as they stood, they were ruled to be in breach of the patents. Would a minor alteration to the marker, although not alter the fact that they are in breech of the patent, still require afresh injunctio to enforce it?

I wonder...

So in a worst case scenario
the SP markers  could become the only legal tournament markers since they are NOT reprogrammable anymore ??

So the boards are no longer re-programmable.

So that means no changing of modes, RoF, and dwell settings? To me that is reprogramming. But what would I know?

[edit - add] Actually, thinking about it, it probably just means that the chip is of the type that wll not accept any changes to the programming at all - things like dwell settings, RoFs would be stored in some form of ram type memory, and there is a slight battery drain to keep these settings stored.
