Pa Has Taken All Teams that dropped out to court, (EDITED DUE TO MISREAD BY SOMEONE)

When we pulled our PA squad out it happened after we talked to Gillie and Hatts. Better said the team/squad manager did.
The squad did fold and there was no team that we could have send to the pa. They have accepted our withdrawel and we have not received one of those nasty letters yet.

It did say if a team folds that they would not take any actions. So I think they kept their word in that department.

First off, if it's on a sheet from the beginning of the season - nothing has changed PA wise.

The ramping was discussed WAY before the season started, both here, with managers and on the PA boards.

The venue changed BEFORE the season started, everyone was told it would be at Ancaster - otherwise, where the hell did you go the first leg of the season.

For the teams that left the PA mid season, I think they (PA) are right to want there money becasue you did back out of the season. You knew the PA was a season based league and you leaving (although I can appreciate it was no fun coming near the bottom each round) would mean a diminished playing experience for others in the league. However, I also agree with almost everyone here that it will be near impossible for them (PA) to get the money they are owed from these teams.

I think it's just a painful learning curve for those wanting to set up a more 'professional' league with organised teams locked in and said teams trying to become more organised (let's face it, if you can't manage a full season, what hope will you have in the long run) so that they CAN commit to a full season. This process is bound to produce some fall out. Just a shame it is taking on a 'legal' form.

well Red Heat folded at the start of May so there wouldn't have been a team to attend the last few rounds. at least, would they be excused from paying the round fees after May

I love this stuff, the old County Court Claims from the PA, well I have to say its not a bad way of wasting the courts' time, spending money on solicitors fees and court fees with little chance of gaining a judgement.

Firstly, a potential creditor has an obligation under the Office of Fair Trading guidelines to prove a debt, I would suggest for a bit of fun a written request to the PA asking for a full breakdown on how this debt was incurred and a copy of any credit agreements that the courts would no doubt require should a claim be issued and an acknowledgement of service returned with a defence. Hell the Data Protection Act is always good for a giggle too, send them a written request for a copy of all stored information on yourself with the fee and point out they have a legal obligation to provide this.

Secondly, I think a paintball team is quite possibly one of the hardest legal entities to litigate against, its a group of people more often than not with no formal agreement between them. All it would take would be for the team to dispand and the case seems pretty pointless to me.

Thirdly, let them issue claims, they have to send a county court claim form to your address and all you have to do is file and acknowledgement of service to the county court which entitles you to a further 21 days to file a defence. File a counterclaim for damages incurred under breech of contract by the PA if you consider the rules/safety issues were an acceptable reason to breech the so-called 'contract'. I cant see how a CCJ against a team is likely to be enforceable even if a judgement is gained. Oh look my paintball team is blacklisted for 6 years! Thats a threat and a half. Even if a judgement is allowed by the court, the courts allow reasonable time for the debt to be paid within the means of the debtor. What are they gonna do if you default after a judgement... get a warrant to send in bailiffs? where would you send them?

Another one that would be fun if you really felt like paying the PA instead of going to court might be to submit a financial statement showing how much you can afford to repay (within the county court guidelines available from me at request) and pay them say £1 per month, I'm sure they would like that.

My company issues thousands of CCJs every year, but I doubt very much we'd even consider issuing a judgement against a paintball team on behalf of one of our major clients let alone an organisation like the PA, with no signed, written credit agreement it just makes no sense.

Nice to see the professionalism of the PA hasnt changed and they seem to think court action is a good idea against people who probably struggle to play the sport they love as it is... great way to encourage the growth of paintball within the UK. Obviously the league can't be as successful as some would have us believe if they're that desperate for money that they need to pursue customers who've left their custom as they believe the service wasn't up to scratch to make ends meet.

That said I haven't really bothered to read the whole thread so everything I say may be utter BS!

Here's a question for the teams who have had this request for payment.

Has the place that you vacated been taken by another team.?

If the answer is yes, then why does the PA require payment for the games you didn't play, when they've been paid for by the new team.

Is this just greed or mismanagment.

Can i please respond to your comment regarding that everyone new about ancaster
i think you will remember that at the conference we were all told that after lunch we would vote for moving to a more suitable venue and russel did say he had to look at another event as rodbaston fields had not been kept up to scratch a few teams did have a walk down at lunch and could not see any problems with the fields. I then now to 2 teams that did not attend the conference but were contacted by russel and told of the venue change and that all that were at the conference had voted for the change to rodbaston ( Was this a lie )

It is even more simple than that.
None of the teams have legal members as they are a group of guys who turn up and play and have no contract to the team.

I could be mistaken and Jose might know the answer to this but did the contract not have the team name on and not an individuals, and also I know at least two teams who have recieved these letters who did not recieve a copy of the contracts making it all worth bollocks all.

I have showed some one from a legal back ground this and he says he would take the case for no fee at all providing the person will counter claim for costs.
Under no circumstance will you have to pay anything.

any teams recieving these letters PM me if you need help guys.

While all this second and third hand legal gibberish sounds swell it might be of more interest to discuss the political ramifications of this action, since, by the sound of it, pretty nearly none of you are actually qualified to intelligently debate the relative legal merits.
A more interesting question is where does this lead the PA in the future? How will it affect next year's series, etc?
