It would be nice if there refs had time before every game to check all players equipment and enforce the hopper/goggle/clothing rules. The reality is that there is seldom enough time or manpower to do this AND stay on schedule. If a player chooses to break a rule, whether it's a "silly" clothing or wiping paint, they're taking a risk of getting caught and penalized.
So, you know the rules but you go on the field with your cut goggles/camo hopper. Maybe you get away with it, maybe the ref catches you. if you get caught, stop whining. The ref didn't make you wear 2 sweatshirts under you jersey, just like he didn't make you wipe that fat hopper hit on the bunker.
And the black & white/color thing? The simple explanation is that they aren't colors, they're conditions. Black is the abscence of all color (hence it absorbs the full spectrum of light) and white is the presence of all color (therefore it reflects the full spectrum of light).
