So in that case, why did you knowing pay for a marker to someone who is under-age?

Now I haven't read the law on the paintball guns so I maybe wrong but how can there be so many under 18s or whatever the age is with their own kit if it is illegal?

It isnt illegal for under 18's to have paintball guns aslong as they are used on a paintball site that is ran properly under supervision.

And in all honesty, stu did not sell the gun to josh, he sold it to you because the money came out of your paypal?:rolleyes:

im sure selling to minor is against the firearms act, some one correct if im wrong, as we also run a busy site on the wirral, cheshire, we have strict policy to protect children and the supply of markers;)

im sorry, im not sticking up for anyone here, but you've practically just gone "here, take this sweet little child in the street, take it. O NO YOU TOOK A SWEET FROM AN OLD MAN IN THE STREET IM SUEING!"

Well actually I think you'll find the law stands on Mr Grieves side.

The minute the marker entered your/nephews possession, it is your/nephews responsibility. As with most shops, if the product is found to be faulty, then you'll be asked to return it in the condition it was sent. At this point in time the item is still your/nephews responsibility. If when returning it, you do not take out adequate postal insurance against the item, the responsibility lies with you!

Furthermore if the RM don't have a signature against the parcel, then they have no way of proving it was ever delivered.

There's no specific laws about selling to minors, many places use the airgun laws as a guideline so no sales to under 14's and under 18's need a parent involved. I'd drop the 'selling to a minor' part if I were you as if it's an offense to sell something to a minor it's in some cases an offense for them to try and buy it, and there are lots of teenage players who buy and sell kit without problems.
I sent a marker out today and used Royal Mail Special Delivery for cover up to £500. Choose the cheaper option and you get less cover:(
Given the number of stories in the press recently about the Royal Mail keeping parcels and selling bagpipes on eBay etc I'd be a little wary of accusing someone of theft based on their word, especially as they don't seem to be able to produce signatures for either of the 'delivered' items in question:rolleyes:

yes i do have proof and also a written confirmation of delivery, or did you think i was foing this for fun, oh and also i think the sales of goods act 1979 applies, if an item is sold in working order then deems to be faulty then either a fix or refund applies. so can the people who seem intent on making this a flame back, off this is a pending legal action, not a play on comments
