reguarless of weather the parcel was signed for detracts from the following, legal stature in the uk if its posted its delivered, this is classed as beggers belief, also the fact the royal mail sorting office and postman have confirmed they have delivered the parcel as well as the letter, which stuart knows were no signed for, if the parcel was no signed for nor delivered the royal mail system is, it waits in the sorting office then is returned to the sender by default, i would however point out the persons not helping this debate by using swear words and not helping this matter, we have been more than patient and fair in this matter, so i ask stuart to do the same,

facts = he rang me to tell me he was going to go to the post office then ring me on the monday as indicated in my pre-legal letter above, he did not do this,,,,,,,,,, so why ??

quite simple the lack of communication is what bury ones head in the sand applies, hoping someone from cheshire is not going to follow this up in southampton, dead wrong on that one, out of principle i will make this trip if not just for my gunless nephew:mad:

confirmed

Dusty,

I know what you mean, although as Stu has now confirmed, the marker was teched and posted out in full working order. It is fair that the marker should be returned to Stu for fixing and that was agreed by both sides, but the reason for this thread was related to Stu being accused of holding onto the marker once delivered and failing to cooperate with Nutz in having it fixed.

As the marker was clearly not delivered, it does now come down to the level of insurance held on the marker when it was posted and who should take responsibility for its loss.

-Will
you miss the simple point will, even though the marker was not signed for it has been confirmed delivered by the royal mail

i have been watching this and as it stands at the moment with fkinpaintball's last comment it either looks as if nephew managed to break it as soon as he got it and he decided to say it was broken when he recieved it OR it was broken in transit. sorry for stating the obvious:eek:

and now royal mail has gone and lost it which is not suprising:(

i just hope it all gets sorted out for you both
currently swat josh is in oz, im sure i can get in touch so he can cut and paste his comms with stuart, and from i can remember he made a post on here about the broken marker, were stuart agreed to sort it, josh however is part of our team who all use ego's we are very techy when it comes to markers, so no josh did not break it mate, trust me or take sides, either way still needs resolving and we have only got proof of receipt, not proof on signature;)

firearms act

im sure selling to minor is against the firearms act, some one correct if im wrong, as we also run a busy site on the wirral, cheshire, we have strict policy to protect children and the supply of markers;)

So in that case, why did you knowing pay for a marker to someone who is under-age?

Now I haven't read the law on the paintball guns so I maybe wrong but how can there be so many under 18s or whatever the age is with their own kit if it is illegal?

recorded delivery offers what

look, can you not file a dispute with royal mail, and if it was lost then you shall get the money back from the insurance on it.
the most we can claim is £30.00 otherwise i would not be pushing this issue. so after investigation he has the marker, sorry but i cannot change the facts, or shall i be nieve and think its sitting in a big hanger like on indiana jones and the lost ark, racks and racks of boxes, going knowere.
also i have waisted a lot of time on the phone calling their logistics team in ireland who investigated the parcel in question:cool:
