Whatever your views on the morality of their case, or the ethics behind it, or the strange ways in which tha legal system can work, tha fact is that, at least when it comes to the Timmy, NPS appears to feel that the case is rock solid. Someone like Gino doesn't give up or back down unless he knows he ain't gonna win.
Hang on. All the PR says is that soem sort of accomodation has been reached between the two parties. For all anyone knows the deal was SP won't screw with NPS and NPS won't screw with SP. Or that NPS will agree to some sort of licensing fee but no telling what the details are or if there was some sort of reciprocal agreement.
All it really means is one of the players who had the resources to resist is no longer part of the equation.

There's probably a lot more politics going on there than any of us realise.

From what i know of the parties involved, Smart Parts arnt the ones likely to be doing the intimidating. I'm guessing that they reached an agreement that will probably make both parties much richer in the end. Lawsuits can create some strange bedfellows, remember Diablo vs National? Instead of going after each other for the name Diablo, they just form together to create a super paint empire! Now it's three parties, Draxxus, National and SmartParts. Who's going to stand in the way of that?

I don't really know much about patents, but from what I do know, patents granted in the US are only subject to US jurisdiction.

For patents to apply in other parts of the world, the company has to apply for patents in those parts of the world.

The upshot of this (that I can see) is that if Smart Parts have not been granted the same patents in Europe/UK, European companies such as WDP will still be free to manufacture markers as they see fit.

Assuming that SP don't have the same patents in Europe, the question then arises as to the legality of importing, say Angels, into the US or other areas that SP hold patents. And would there be anything stopping a player from Europe bringing and Angel into the US to use in a tournament?

Whatever, the situation is still incredibly naff, and beggars belief as to how the US Petents Office could let someone get this far with such a stupid patent.

I like Smart Parts products, but I, for one, would certainly support any Smart Parts embargo - starting NOW! - as the only really effective means of letting SP know where they stand with the players.

I suggest that we all let Smart Parts sales phone lines and internet ordering go quiet as of NOW.

1. SP tried to have european patents too but fortunatel the patent system works better here. (read: they were thrown out)


2. WDP makes most of their money in the US not in europe. So if SP has a court verdict that they cannot sell Angels without paying the royalty they are screwed.
