The final responsibilty with checking the law in the country you travel into lies solely with the individual.

The F stamp requirement has been in place for many years now - we used to have to send our markers to John Sosta who could F stamp markers as legal in Germany.

Having said that I think that the organisers should bear some responsibility as it would not have been unreasonable for them to include this info on the website or by e-mail.

My advice - don't bother with the German events until they sort it all out.

OK, so what should the promoters have done in advance in support of your case? the correct answer is: nothing. there is no way in hell you could get it through customs. so play the odds.
And now a team got shafted because there was no information available that this could happen!! If they would have known about the situation it would have been their choise to take the risk and loose their guns when going over to Germany. I guess this is again a situation where the promoter decides not to inform anyone and just hopes that nothing bad happens ?!?

It would be interesting to see if the court would hold the event organizers responsible for withholding this information as a part of event promotion. Sure, gun law is gun law, but consumer protection regulations are an entirely different thing.

As a team, Takeover purchased a service that did not have sufficient information of the possible legal consequences related to the attendance to the event. The information about the gun laws in germany can be aquired from all kinds of european law websites and services. However, it does not change the fact that when Takeover agreed to participate to this event, sufficient information was not provided by the event organizers.

If i was to invite someone to Finland to smoke some weed, i would be held liable as an accomplice. As Takeover was invited to take part in illegal activity without informing them of it, that would make the organizers at least partially liable. This, according to my reasoning, would be the case in both consumer- and criminal prosecution. Hopefully Takeover considers looking further into this option.

As Mark has said - I think the answer is to not play German events until this is sorted out.

I know this sounds real harsh - but the issues in Germany relating to paintball have been a talked about issue for as long as I can remember.

I have heard rumours that Max's Masters is held on US property? Is this true? If so that could be the organisers ticket out of any responsibility if this has any direct effect on the law.

NOTE: Im not assuming any of the above to be true - just things I have heard to be so.

I think the Millennium should take more responsibility in this area. Firstly see if they can aid in any way those players that have had the misfortune of markers being taken. Perhaps they can act as a central point for players to have a single lawyer? I am not suggesting the Millennium cover the costs of said legal battles but just to aid the players in finding a resolution. Besides this is your customers that may not be able to play any more events this season!

Secondly the Millennium should also investigate what is REQUIRED by German law to pass the markers legally through customs. Based on the results, this info should then be made readily available for all teams entering next year OR make the decision to remove the MAX's Millennium Status.

It is a shame its like this, but don't start having a pop at other players because of it. It's not our fault that these laws exist in Germany and as much as I would happily join any petitions etc, why should we start breaking the law and lose expensive kit to aid in the battle to correct it?

Thanks for the support guys, but more constructive discussion, please!

I agree that it would be very nice to know from the promoter if there is problems with the law. But we are not to blame this on Maxs. Actually they have been very helpful and we just hope we can together work a way out to get our markers back! Otherwise it might ruin our whole season as I mentioned. Anyway, it was a great tournament!

We are supposed to play many Millenniums and the world cup and I hope this doesn't affect on that. Also we haven't worked out how are we gonna play the first finnish X-ball round in less than a two weeks now. I hope our sponsors (WDP, Sissos Finland and DraXxus) and our friends could help us out with that.

Thanks for your support guys and let's keep the discussion constructive in this thread! And thanks to Maxs for starting to help us with this incident!

Juho/Takeover

p.s. I have something to tell you guys about the legal issues to be solved with paintball around Europe soon... I just started studying the subject more deeply and I have good resources as I work in the finnish parliament.
