hey - new thread - great, now I can turn off the ignore button.

Is this APPA going to be the same kind of not real non-profit corporation that the NCPA is (the NCPA is a NON STOCK corporation registered in Wisconsin, but is NOT a tax exempt 501(c)3 or 501(c)4 corporation, so far as I've been able to find from the IRS - the people who such a thing has to be applied to for) or are you going to spend the time and money and apply for 501(c)3 status?

Steve: Who is following who around now? ;) But to answer your question, yes. The database system is a precursor to having a system that will allow people who get full memberships to vote in an easy, convenient manner. I don't know when I'll get enough time together to put the infrastructure in to be able to process full memberships, but elections will be a few months after that point and then whoever is elected can steer the organization through incorporation. My main thing is I'd like to find a lawyer willing to donate their time to write up articles of incorporation as those which would let an organization do some lobbying while still being non-profit are a little more complicated than the NCPA's with a lot more at stake (operating as a 501-c(3) to promote amateur athletics is pretty straightforward, operating to promote paintball participation and safety and legislation germane to that cause is a little more tricky.)

As for the NCPA, you don't have to file until you bring in more than $5,000 in one year or 27 months after your incorporation date, whichever comes second. That's December for us. They generally want 2 years of budget history when you file anyway.

I have no idea where you're getting the "considerable expense" BS from. It cost me $35 or so to incorporate the organization, and maybe a few bucks for our EIN. Submitting the application for a letter of exemption is less than $100 - maybe free, it's been a bit since I looked at the fees. Now, the form IS over 30 pages long, so if you hire an accountant to do it it may cost you a bit, but if you keep good books and ahve an accountant willing to donate their time, it's not a big deal.

Believe me, we're going to spend the time though - one because I don't want the IRS knocking on my door come December :) but two because things like not having to pay sales tax are nice.
