Paintball markers are not "specifically" covered under the firearms act......... but whenever the home office mention them they keep things in a grey area......... they say "could be argued that" and "may be" never yes or no......... they have stated on a number of occassions that a full auto marker/hard ammo etc... would be considered a firearms offence, BUT it would be for the courts to decide on each specific case...... i.e. they aren't sure how a court would see it so they are hedging their bets. So, they haven't said that an auto marker is specifically illegal, but that doesn't matter........ they haven't said it's OK, that's more important. They have stated that a single shot marker firing frangible rounds is legal....... so to extrapolate..... anything else could lead to prosecution, the first time this happens will set a precedent.
And to anyone who still thinks this isn't true.... in the last batch of consultation papers on the firearms act, it was put forward that "it could be argued that any paintball marker is an illegal firearm" i.e. any offence committed with one could potentialy be prosecuted as a firearms offence. The main reason for this is our exemption from firearms control under "lethality" unfortunately our use of the word lethal does not correspond to the term under UK law...... the definition is "to cause significant injury" not"to kill" I'd consider blinding a significant injury as would most people.... so lots of nice grey areas.
Why don't we just stick to what they've said we can use? there's no legitimate use for full autos anyway....... sites and tourneys won't let you use them, so where are they being shot?
I agree with Olley on the cheap plastic blowback thing too........ where the hell are they all being fired? they sell plenty in army surplus shops/tackle shops etc.... but I've never, ever seen one on a paintball field...... so where are they being fired? and mail order paint in bags of 500? where's that being used?
