yea go wiv name and shame then small claims court. if person who skanked me is reading this then u got ur warning for wots happening if i dont get money by monday. Ive also heard this has happened b4 by you to another of ur so called friends.
Well I still havent heard a peep from this guy so it looks like I will have to resort to naming and shaming then small claims court.

Just be careful with the name and shame thing...Next thing you know,you lose the case and then get counter sued for libel..Small claims court is your best available option to get it sorted..Just make sure you have all the proper emails and any correspondence you may have had with the offending party when you walk into court..When thats all sorted,then you would have no problem in naming the person..Should be a walk in the park as long as he didnt state "as is" when you purchased it..Good luck with the sucky situation you've been thrust into...
im fairly certain that any product bought has a 30 day warrenty on it, even if its second hand and you've signed a seen as sold form.
If you haven't signed a seen as sold form then you have bought the marker in good faith that its in fully working order.
If you have a copy of the email he sent you then you have every right to demand your money back or you can have it repaired and bill him for it.
So warn the guy that you will have it repaired if he does not return your money and the invoice will be going to him (probably cost more than the guns worth)
this is all on the assumption that in law this is treated the same as second hand cars.

I am in contact with the guy now so hopefully it can be sorted out in a civil manner. Anyway thanks guys for all your help and advice
