Could really do with your opinions

OK heres the score.

I bought a marker off a guy who was advertising in the classified section. After recieving it I discovered it was totally knackered. The holes for screwing the grip frame into were totally worn. Also parts were missing. The body of the marker was in p!ss poor condidtion too but I realize that that s the risk you take when buying second hand. So the end result is that I have bought something which is completely unuseable. Oh and when advertising the marker, I was assured that nothing was missing and the marker was guarenteed to work.

How would you recommend resolving this situation? I have sent an email stating the above defects ( Saturday) and am waiting a reply. The big problem is that this was bought for a mate (he doesnt have access to a PC and is a little concerned he has wasted his money).

I am not gonna name names as I am sure this can be sorted out but would value any advice just in case it cannot be resolved.

Couple of options...

1. Give us an address and we go put the heavies on ;)
2. Legal stuff, small claims court

Either way i would mail him stating you wish to terminate the sale as recieved goods were not as stated by him. Offer him return of goods for return of your monies. But mention that action will be taken if he disagrees to comply.
That way you are being fair but firm.
Have you kept all correspondence between you and the seller as proof?
If not you are kinda screwed mate :(

I assume you would have the guys (or girls :) ) name and address anyway for sending a cheque off.

Also it would be helpful to have a copy of correspondance (e-mail etc) and also print out a copy of the relevant classified post from the forum.

Contact the guy and teel him that your unhappy (as you seem to have done through e-mail) and make sure you keep a copy of anything you send/receive.

If its anyone regular on the boards I would like to think that you won't have a problem resolving the situation as I'd like to think everyone on here is fair and honest (I know it ain't a perfect world but I've never had any problems).

If you fail to get a response, then your only option would be the small claims court :(

Really depends what it's worth in the first place, although I always find subtlety the best route so, sleep with his wife / girlfriend / boyfriend / mum / rubber doll / sheep

(DELETE AS APPROPRIATE)

And it wouldnt get his back up at all, and he would never tell you to piss off if you said that to him. He has the power over you cos he has your money....its more your problem than hism if i was you i would be careful what you say to him in case he refuses to give you your money back.
