Or changed the design slightly ... or used colour ranges that aren't within the patent (i.e. Pink venomwear i doubt was an original colour).

I built the flying skull pattern on the corrupted straps from scratch as a commission. Completely unsure whether or not copyright permission has been attained however I can tell you the colours used are new, and everything seen on the strap has been built from the ground up on photoshop.

You cant patent a picture. You can only copyright it. And seeing as your man says he built the design up from the ground its a different design and as such a different copyright.
