And what? @connor96 has more than 3 times as many posts as you and much more recent ones at that so who is more experienced with this forum and its current rules?

Because that's not legal, I run a business and I know what I can and can not do as a professional or a private sale. My contract of sale is with the seller not royal mail, therefor my contract with the seller has not been for filled. (The seller has not delivered the goods after I have made payment ) regardless of Royal Mail are to blame they are the seller chosen courier/delivery service, I have not employed/paid them to transport my purchase from the seller. As I have not received my purchase the seller is in breach of our sale contract. (I pay the seller £450 for the items advertised, he agrees to send me the products). So now as good have failed to be delivered I am legally required to a full refund or take seller to court to reclaim amount and any costs involved in obtaining my refund. That's the simplest way I can put this.
Clearly you have no idea what you're talking about. You are most certainly not legally "required" to anything. I believe "obliged" was the word you were planning to use. Even at that the seller has the right to offer you a replacement item which could take time to source.

You actually come across as the sort of person who think they know everything but your lack of grasp of the English language lets you down. Badly.

Rights are exactly the same except PayPal ack as mediator service to ensure goods are as described and get delivered. PayPal have access to accounts and hold money / have access to users accounts to issue refunds if resolution service fails. A form of in house small claims court. But with faster results. They are providing there service using statutory rights and sales of goods act laws.
Nonsense, buying used goods from a business is completely different to buying used goods from a private individual. You can't seem to grasp that concept at all. In fact I'm really tempted to tell you to take it to small claims court, you'll have to wait much longer and go through an awful lot more hassle to get your money, on top of which it will cost you time and money to get it back when it's already being dealt with.

You have a tracking number so can see via Royal Mail how far it got into the system
It may still reappear which is part of the reason for the delay before RM claims will pay out

If you used PayPal you will have had the added protection of them handling the money, and by default they side with the buyer and pretty much give an instant refund service

You sent money by bank transfer, not the ideal situation and it saved you some money on PayPal fees - about 4%
The seller can either refund you straight away - if he still has the money in the bank, and if he takes the risk that the package does not turn up before RM compensate him, or he can wait for RM compensate and then pay you back from that
(Assuming the right insurance level was in place, otherwise it's between you two - if a lower postal price was negotiated between you both the you have both contributed to only partial compensation, if one of you decided on that level of postage then that party may take the bit on the difference)

The key factor being this is a private sale. Less rights exist, some legal obligations remain, you could go to court but in the current timeframe a court will pretty much just throw it out when the seller says 'I am going to refund when RM give the compensation'

From my perspective the reason why I had cause for concern was that following payment (through paypal) Gambo promised that he would send the item immediately and have it delivered by the end of the week. Despite my attempts throughout the week to ascertain whether or not the item had been sent I received no response. A week went by and I still had no response. I then saw on the forum that Danny was experiencing issues with delivery. I ask you: would you be concerned had you been in my position? Conversely if you had taken £350 off someone then promised to deliver a product do you think it reasonable to not only fail to do it but also fail to even advise this? It was only after raising a paypal dispute did I receive a response advising that he has not sent the item.

Its clear that there is some disparity in peoples understanding of the law when purchasing second hand goods and I echo Danny's comments and would be more than willing to assist with clarifying this. This is not in an effort to change the website, but manage people's expectations when it comes to what the average man can expect when buying or selling through P8ntballer (and what remedy's are on offer should either party fail to live up to those expectations).

In terms of the 2 transactions that generated this discussion point; the proof will be in the pudding. Gambo has now advised that my item has been sent and when I receive it I will close my paypal dispute. Danny can wait for the agreed period before deciding which action to take but ultimately he is entitled to either (a) the product he purchased or (b) a full refund. I trust that if either of these things do not happen the mods of the site will then side with the buyers and remove Gambo's account.

Really trying to not get involved but it seems the blame lies with the post office not the sender.

I would struggle to find that sort of amount to pay a buyer back if they ever lost anything I had sent to that value.

Even if it had been paid via PayPal as goods so was protected it takes 2-3 weeks to get any money returned.

Sorry I was being a facetious pedant, small claims is a track a case can be allocated to in the county court, the claim is brought in the county court and, if defended, is allocated to a track by the judge. If the claim is for less than £10,000 and reletively straight forward the judge will normally choose the small claims track. So if a claim was brought in respect of this matter it would, if defended, probably end up on the small claims track.

Anyone is entitled to bring a claim against anyone else for anything they think is owed, however the civil proceedure rules state that every effort must be made to resolve the matter between the parties before a claim is brought.

Another issue is that if you pay via PayPal you do not know the sellers address, without an address you can't serve paperwork. Paypal would be unlikley to reveal a sellers address as this would, most likely, put them in breach of the data protection act although you could obtain an order through the court to force PayPal to reveal the information.

Anyway I suspect this is all conjecture and hopefully this will all be resolved amicably very soon.

As you have alluded to, Gambo is in the process of rectifying any issues. There has to be a certain amount of goodwill but that does apply to both sides. Danny should not be acting all billy big balls about it while Gambo has made clear publicly and privately he is working on it. It's very much against the ethos here and once this is all done and dusted Danny needs to be very clear that this forum is of much more value to him than he is to us.

It could equally be argued that the buyer has specified the choice of delivery and outside of that can Gambo be expected to be held responsible for Royal Mail? I am not privvy to the final details but if SD was requested, Gambo can provide proof it was provided........... there is more than one way to see things.

Again, all very nice and to the letter of the law yes he can proceed with the legal route but AS A LAST RESORT once all other avenues to recover the goods have been exhausted. However, the practical and realistic resolution is to sort it out like adults which will be more amicable and much quicker.

There is also the possibility that Royal Mail will recover and deliver the parcel.

Key to all of this, I think it is fairly clear Gambo did not intentionally set out to diddle anyone and has made clear is taking steps to rectify things. Things happen, real life can get in the way. I can understand fully both sides of the story but in this case Danny's attitude isn't convincing me that we should be offering any assistance at all.

The basic rules of the forum regarding common courtesy and mutual respect still apply no matter the circumstances, remember you are here at OUR discretion, it is not a democracy and you are certainly not entitled to membership. If the Mods feel that a certain member is detrimental to the running of the forum you can all rest assured the tail will most certainly not wag the dog.

I believe the issue underlying is this modern sense of entitlement people have. Not too many moons ago, hundreds upon hundreds of markers and items were bought and sold here, often by bank transfer and often without even a picture. I bought more than one marker at considerable sums of money completely blind based solely on the sellers reputation and the fact a man's word was his bond. Never had any issues either.

It seems to me that the seller is not trying to rip anyone off, and that he is doing his best to resolve it.
If it was me and I got the whole attitude from the buyer, I would be inclined to tell him to suck it.
I can see the frustration, but sometimes things are taken out of ones control, not everyone has funds to give back, if he has to wait to get funds, then unfortunately so should you.
This guy is obviously not trying to scam anyone, I just hate people with attitude and demanding what is their "right", when it clearly is not, Caveat emptor, this is a private sale and you should as the latin says, beware.
Just be reasonable DannyC, He is not trying to scam you,
