Ok so I've looked all over and can't find the answer. I'm going on holiday to Florida if I buy a paintball gun I know it says it has to go in checked luggage but will I still have to pay tax on the item as I am not shipping ???

Technically yes you should.
Practically hundreds of players bring gats back through customs all the time.
The only issue you may have is as you are not going away to play is explaining why it is in your luggage. When we went and bought gats back we were playing.

I would leave it on top of your suitcase ( don't hide it under loads of clothes) try and buy a paintball mag and leave it with it. Just walk through the nothing to declare exit and you will be fine.
