Since the above post doesn't really help improve your chances of being considered smart, I'd change it for a number of reasons. A few of them being:
1) It's kinda rude to shout, and using big fonts is considered shouting.
2) The man's name was not Marianus Van Der Lubbe, but Marinus van der Lubbe. You got his first name wrong, and van and der do not get capitals. It's how we Dutch do...
3) Marinus van der Lubbe did most certainly have his day in court. He was tried along with Ernst Torgler, who was the Chairman of the German Communist Party (the KPD) and three Bulgarian Communists. Torgler and the three Bulgarians handled their defense so well that they were found not guilty, but Marinus van der Lubbe was found guilty and sentenced to death. He was beheaded on january 10th, 1934 in Leipzig.
Please get your facts straight. I love a good conspiracy, but yours is shaky to say the least...
